Supreme Court Upholds USF Contribution Methodology
In a 6-3 decision on June 27, 2025, the Supreme Court upheld the constitutionality of the federal universal service program’s contribution mechanism.
In FCC v. Consumers’ Research, the Court considered whether the USF contribution mechanism violates the nondelegation doctrine, “either because Congress has given away its power to the FCC or because the FCC has given away its power to a private company [USAC].” The Court held that neither of these two delegations, alone or in combination, violates the Constitution.
